2 injured in Massachusetts car accident; Drunk minor to blame?

Two teenagers were injured after a woman who is said to have previously admitted to intoxication in a text message crashed headlong into their car in the early hours of June 1. The car accident left both passengers of the opposing vehicle with moderate to severe injuries. Massachusetts police have arrested the underage woman, who allegedly texted a friend about her drunken state before setting out. She has pleaded not guilty to the charges she faces.

According to the victims, the accused driver was texting while driving on the wrong side of the road. She allegedly ignored repeated attempts to warn her off her course, including high beams. The two cars collided causing significant damage to both vehicles. Both the driver and passenger of the second car were injured, sustaining multiple fractures of their arms.

Police arriving on the scene were informed by the victims that the driver appeared to be intoxicated. A blood alcohol test is said to have confirmed she was over twice the legal limit in Massachusetts. She denied being drunk but police say they found a text on her cell phone that indicated she had been drinking. She was arrested on site for impaired driving.

Considering the evidence arrayed against her, the young woman charged with drunk driving may be found criminally responsible for this car accident. Given the injuries sustained by the victims and the damage to their vehicle, both of them have the right to pursue a personal injury suit against the driver deemed negligent for damages to both health and property. Such a case will be handled separately from any criminal charges in a Massachusetts court of civil law.
