Parents are no stranger to scratches and scrapes. These types of injuries are a regular part of childhood. Unfortunately, a parent's worst nightmare, the severe injury or death of a child, can come true as well. One Massachusetts family is reeling from just such a tragedy, after a car struck their 6-year-old son and left him with a brain injury.
Reports following the crash stated that the child is suffering from a brain injury and heart problems. The victim in the accident was crossing the street with his sister when a car struck him. The accident is currently under investigation and police are speaking with witnesses in order to ascertain a better understanding of what happened. The road on which the accident occurred is a heavily traveled, but also is densely populated with children.
There has not been any indication given as to if the driver in the accident will face any criminal charges. While the driver may not currently be found at fault in a criminal sense, he or she could be held liable for the accident in a civil suit. Traumatic brain injuries can leave a person debilitated and needing 24-hour care. Although it is too soon to tell, the parents of the young victim may seek damages in order to provide for the child's medical needs and expenses.
Successfully litigating a personal injury claim regarding an accident in which the victim suffers from a brain injury can help the victim in many ways. Medical expenses can be enormous, parents may have to take time off from work to care for the injured child and the pain and trauma that the child suffered may be intense. If a Massachusetts court is convinced the driver was at fault in the claim, monetary awards could help offset the cost of medical and other expenses the family will incur due to this accident.
