Woman found in the street was victim of motor vehicle accident

The body of a lifeless woman was found lying in a street in the Massachusetts city of Revere. The 911 caller that reported the presence of the body did not know how the motor vehicle accident victim ended up in the street. The police investigation into the incident led to an MBTA bus driver.

Police discovered an MBTA bus in the area where the woman was found and interviewed the driver. The next day it was determined through unknown sources that the bus went out of service after the victim, who was reportedly the last passenger aboard, got off the bus. Somehow, the woman was hit by the bus and dragged for approximately one-half mile to the location where her body was discovered.

When police questioned the bus driver, he apparently did not exhibit any signs of impairment. Nonetheless, he agreed to submit to an alcohol and drug test in accordance with the MBTA's policy in the event of an accident. Hopefully, an accident reconstruction team can shed some light on what happened. No information as to whether the bus driver knew he had hit the woman was reported.

It was reported, however, that he hired legal counsel. He may need counsel for more than any possible criminal charges. The surviving relatives of the victim may exercise their right to file a wrongful death claim against the driver and MBTA in connection with this horrific motor vehicle accident. The MBTA could face liability for the actions of the bus driver since the preliminary evidence suggests he was on-the-job and in the performance of his duties at the time of the accident. Under Massachusetts law, a successful claim could provide the family with a monetary award for damages incurred due to the victim's death.
